Mariah Carey Is Facing A Lawsuit Of $20 Million For The Hit Number ‘All I Want For Christmas Is You’

New Orleans-based songwriter Andy Stone has filed a lawsuit against Mariah Carey for copyright infringement for the track ‘All I Want for Christmas Is You’

Songwriter from New Orleans, Andy Stone has sued Mariah Carey for the hit number ‘All I Want for Christmas Is You’. The singer is sued for a massive $20 million lawsuit for damages.

According to the latest reports, Andy has claimed to have written the same track with the same lyricism and title 5 years prior to Mariah Carey’s hit number. He has co-written the track however, the topic never surfaced in the media.

Andy Stone’s track was previously released in 1989 under his country-pop band named, ‘Vince Vance & the Valiants’. On the other hand, Stone claims the same track is issued in Mariah Carey’s hit LP ‘Merry Chirstmas’ that dropped in 1994.

The singer is being sued for misappropriation and copyright infringement issues along with Sony Music Entertainment as well as her co-writer Walter Afanasieff who develop the track. However, representatives of the singer and her teammates offered no comments regarding the issue.

The lawsuit was filed on Friday at the New Orleans federal court. Songwriter Andy Stone further claimed that Walter Afanasieff has made a “derivative” version of the track and utilized it to create the hit single ‘All I Want for Christmas Is You.

 As far as concerning the issue of a copyright infringement lawsuit, it claimed that the song comes with the same title other than its similarity in the music or lyricism. Mr. Stone tried to convey that as the writer of the hit single ‘All I Want for Christmas Is You’, he has the copyright to call that title his own.

                                         

The lawsuit further claimed that “Defendants knew or should have known of Plaintiff’s copyright,” and also emphasized the fact that Stone’s single also received extensive airplay during Christmas in 1993.

The track ‘All I Want for Christmas Is You’ is one of the greatest hits that has garnered more than a billion streams on Spotify and views on YouTube. After so much popularity, Stone decided to make the lawsuit in April 2021 which somehow got ignored.

However, the lawsuit could face other issues since this is not the first time. There are a total of 177 songs with the copyright of the title ‘All I Want for Christmas Is You’ and some of them are even before 1989.

According to Intellectual property rights, “Song titles aren’t entitled to copyright protection.”
